These Terms & Conditions (“T&Cs”) govern use of the GrassForce website and engagement of GrassForce services (a division of Ignite4 Pty Ltd, ABN 66 623 607 396).
By accessing our website, requesting a quote, or approving a proposal, you agree to these T&Cs.
1. Use of Website & Content
- This website provides general information about GrassForce services and educational resources.
- All content is owned by GrassForce and protected under copyright law.
- You may view or share content for personal or educational purposes with clear attribution.
- You may not reproduce, alter, distribute, or use content commercially without written consent.
2. Service Engagement
By engaging GrassForce, clients accept the following service conditions.
Chemical & Herbicide Use and Compliance
- All chemicals are supplied and applied by licensed personnel in compliance with Queensland Biosecurity, EPA, and APVMA regulations.
- All spraying is GPS-guided for accuracy and coverage consistency.
- Clients must observe all withholding periods before grazing, mowing, or harvesting treated areas.
- GrassForce applies all herbicides strictly in accordance with label directions, regulatory requirements, and environmental standards.
- Weed response can vary due to weather, temperature, rainfall, humidity, plant stress, soil moisture, and herbicide resistance. These factors are outside our control; therefore, results cannot be guaranteed.
- If re-treatment is required, it is charged as a new, standard treatment, not covered by warranty.
- GrassForce warrants only that treatments are applied correctly and safely, using the appropriate product, rate, and method for the agreed target and prevailing conditions.
- Where conditions justify adjusting rates or timing (e.g. hot, dry, or stressed conditions), GrassForce may recommend variations from label rates or timing. Such changes are made only with the client’s prior agreement and understanding of the expected impact.
Pasture Establishment
- Pasture establishment is recommended only when soil temperature exceeds 18 °C and there is adequate soil moisture for germination and follow-up rainfall or irrigation to support establishment and plant health.
- Success depends on external factors such as weather, soil structure and fertility, seed quality, grazing management, soil moisture retention, and post-seeding rainfall or irrigation.
- Many of these are outside GrassForce’s control. GrassForce provides services in line with current best-practice agronomy, but results cannot be guaranteed.
Scheduling & Operations
- Project timing may change due to weather, regrowth, or access.
- Machinery downtime may occur; flexibility is appreciated.
- Critical agronomic stages are prioritised to preserve effectiveness.
Fire Risk & Machinery Operations
- Use of tractors, slashers, mulchers, and similar machinery carries an inherent fire risk, particularly under dry or windy conditions.
- GrassForce maintains equipment, monitors conditions, and ceases work when unsafe.
- Despite these precautions, GrassForce is not liable for any fire ignition or resulting damage where work was undertaken safely and outside declared fire bans.
- Clients should maintain appropriate insurance and, where possible, have firefighting water available on-site.
Equipment Risk & Ground Conditions
- Estimates assume normal site conditions.
- Insurable events (e.g. collision, cab damage, internal equipment fire) → GrassForce responsibility.
- Normal wear and tear → GrassForce responsibility.
- Damage or abnormal wear caused by unmarked hazards (rocks, stumps, debris, obstacles) → shared risk and may be on-charged.
- Extra time spent managing hazards or poor access is billable.
Transport & Deliveries
- Bulk inputs (fertiliser, seed, lime, chemicals) are delivered at cost through approved carriers.
- Delivery charges apply only to products, not to machinery travel.
- Clients must ensure safe, dry on-site storage for delivered materials.
3. Client Responsibilities
Clients are responsible for ensuring safe and accurate conditions for all GrassForce works.
To enable safe, efficient, and effective delivery, clients must:
- Provide clear and accurate information about the property and site conditions prior to commencement, including terrain type, slope, rock or debris density, moisture conditions, and known obstacles or hazards.
- If site conditions differ materially from the information provided (for example, undisclosed rocks, debris, or obstructions causing equipment damage or excessive wear), GrassForce reserves the right to charge for time lost, equipment repair or replacement, and any additional works required.
- Provide clear site access (gates unlocked, tracks passable) and maintain reasonable working conditions on site.
- Withhold stock from treatment areas as directed until advised it is safe to return.
- Secure pets and livestock during works.
- Advise of underground services (e.g. irrigation, water, septic, electrical) and mark fragile infrastructure such as risers, tanks, troughs, and drains.
- Identify and mark hazards including washouts, dams, steep slopes, erosion gullies, or soft ground.
- Provide safe, dry storage for delivered inputs (fertiliser, seed, lime, chemicals) if required.
Delays, equipment damage, or additional costs arising from inaccurate site information, unsafe conditions, or obstructions are chargeable to the client.
4. Costs, Payments & Variations
Scheduled and Program Works
- Deposit: A non-refundable deposit including phase 0 (planning, project management) & phase 1 (initial treatment) of the project estimate is required to secure scheduling.
- Progress Payments: Each project phase is invoiced in advance and must be paid before commencement or input materials ordering.
- Non-Refundable Once Scheduled: Once a program phase is scheduled and machinery, labour, and inputs (e.g. herbicides, lime, fertilisers, seed) are allocated or purchased by GrassForce, that phase becomes non-refundable.
- Adjustments: Final costs may vary according to actual input use, site conditions, or approved variations.
- Late Payment: Invoices outstanding more than 14 days may incur administrative fees and suspension of works until payment is received.
- Handling Fee: A handling and compliance fee (Typically 20%) applies to all supplied inputs to cover procurement, logistics, and record-keeping.
Ad-Hoc and One-Off Services
- Applies to stand-alone services such as slashing, spraying, mulching, or inspection visits.
- Minimum Fee: A non-refundable minimum call-out fee applies to all ad-hoc works to cover mobilisation, travel, and setup costs.
- Payment Terms: The balance is payable in full immediately on completion of the service unless otherwise agreed in writing.
- Non-Refundable: Once an ad-hoc service is booked and confirmed, it is non-refundable if cancelled within 48 hours of the scheduled time.
- GrassForce reserves the right to withhold services delivery, results, reports, or documentation until full payment is received.
Variations
- Any change in scope, materials, or timing will be confirmed in writing and charged at the applicable rates.
- GrassForce may adjust pricing or scheduling to reflect changes in input costs, weather delays, or client-requested modifications.
5. Cancellations & Rescheduling
Program and Scheduled Works
- Once a program phase has been scheduled and inputs, machinery, or manpower have been allocated, that phase becomes non-refundable, even if works are later postponed or cancelled by the client.
- Cancellations before inputs are purchased and machinery is assigned may incur up to 50 % of the scheduled phase cost to cover planning and administration.
- If adverse weather or access conditions prevent delivery, GrassForce will reschedule the phase to the next suitable window at its discretion; payments already made will be applied to the rescheduled works.
Ad-Hoc and One-Off Services
- A non-refundable minimum fee applies to all ad-hoc services such as slashing, spraying, or one-off visits.
- Cancellations within 48 hours of the booked time will forfeit the minimum fee in full.
- The remaining balance (if any) is payable immediately upon completion of the service.
- Weather or access delays may require rescheduling at GrassForce’s discretion.
6. Liability & Indemnity
- GrassForce holds current public liability insurance.
- Clients indemnify GrassForce against damage or loss arising from undisclosed or non-visible hazards, unsafe conditions, or deviation from directions.
- GrassForce’s responsibility is strictly limited to the correct and lawful delivery of the treatment or service described.
- No warranty or guarantee is provided for weed control, pasture establishment, soil improvement, or long-term outcomes.
- GrassForce is not liable for any indirect, consequential, or follow-on losses, including crop failure, grazing delay, market loss, or environmental variation.
7. Environmental Responsibility
- GrassForce operates under ethical, least-harm land-management principles in line with Queensland Biosecurity and environmental standards.
- All works aim to protect soil health, water quality, and biodiversity.
8. Intellectual Property & Copyright
- All content, documents, data, maps, photographs, diagrams, designs, and written materials created or provided by GrassForce — including proposals, plans, reports, fact sheets, guides, and digital resources — are protected by copyright and intellectual property law.
- Unless expressly stated otherwise, all intellectual property rights remain the sole property of GrassForce (Ignite4 Pty Ltd, ABN 66 623 607 396).
- No part of any GrassForce document, plan, or website content may be copied, reproduced, adapted, distributed, published, or shared in whole or in part without written consent.
- Materials may be shared internally by clients only for their own property management purposes and may not be used commercially, resold, or supplied to third parties.
- GrassForce reserves the right to pursue legal remedy for unauthorised use, reproduction, or distribution of its intellectual property.
- The GrassForce name, logo, and brand assets are trademarks and must not be used without written permission.
- This includes training materials, workshop content, and advisory documentation provided as part of GrassForce educational or consultancy services.
9. Privacy & Data
- GrassForce manages personal information in accordance with the Privacy Act 1988 (Cth).
- Personal information collected through forms, calls, or emails is used only to provide services or communication.
- Data is not sold or shared except where necessary for service delivery (e.g. freight providers).
- Anonymous analytics and cookies may be used to improve site performance.

10. General Terms
- Acceptance: Acceptance of a quote, proposal, booking confirmation, or payment constitutes agreement to these Terms & Conditions.
- Where a formal quote or proposal has not been issued, but the client requests or allows GrassForce to commence works, such instruction or acceptance of service is deemed full acceptance of these Terms.
- These Terms apply to all GrassForce services, including advisory, educational, add-hoc, and scheduled property or pasture establishment programs.
- Version Control:
- The version of these Terms & Conditions in effect at the time of acceptance or commencement of a service phase will apply to that phase.
- For multi-stage or ongoing programs, each phase is considered a distinct engagement.
- If GrassForce updates its Terms & Conditions before the delivery of a subsequent phase, the latest version in effect at the time that phase is scheduled or delivered will apply to that phase.
- These Terms are governed by the laws of Queensland, Australia.
- Any amendments or special conditions must be confirmed in writing.
- GrassForce may update these Terms at any time; the current version will always be available on the GrassForce website.
- If a client-specific written agreement is in place, those terms will prevail to the extent of any inconsistency with these Terms & Conditions.
